1) This is no way restricts anyone right to speak or even produce porn. 2) The owner of the device controls if the filter is enabled - or at least the may do so if the manufactures provides them ability to do so.
This is literally no different than requiring parental controls on televisions - which the FCC has required for 20 years now.
